1. validity of the general terms and conditions of the “Membershop fans4roger
We provide all deliveries and services on the basis of these terms and conditions in the version valid at the time of the order. These GTC shall apply indefinitely, as long as they have not been changed by the parties in a written agreement. In all other respects, the provisions of the Swiss Code of Obligations regarding the purchase contract as well as other Swiss laws and regulations shall apply.
2. offer and conclusion of contract. Our catalogue and the publications on the Internet are generally non-binding. An offer is valid until revoked, unless otherwise agreed in writing. The offers in the membershop fans4roger can only be ordered by members with paid annual membership. The contract is concluded upon acceptance of the order. In cases of obvious spelling and calculation errors, we are entitled to withdraw from the contract.
3. delivery and dates. The delivery is usually within 3 to 4 working days after receipt of payment, or according to the information in the article / tickets. The shipping costs will be calculated individually depending on the items/tickets ordered. They are valid for shipping as well as for the personal handing over or depositing of the items/tickets. Goods that are not available must be reordered by the customer.
4. fulfilment of the contract. Our confirmation is decisive for the scope and execution of the delivery. If not expressly agreed otherwise, benefit and risk shall pass from the sender to the customer upon dispatch of the goods.
5. payment. The prices are stated in the offer and are not binding during the ordering process. Deliveries are always made after payment of the invoice.
6. retention of title. The delivered goods remain the property of the membershop fans4roger until full payment has been received. If the customer is in default with the payment of the purchase price, the membershop fans4roger is entitled to withdraw from the contract (declaration of withdrawal) and take possession of the goods.
7. taking back
7.1 As a matter of principle, we only replace defective fan club items within 10 days of delivery. Only items that have been delivered and invoiced directly by us to the buyer will be replaced. The goods must be returned with a copy of the invoice and a description of the defect.
7.2 Tickets will not be exchanged, taken back or refunded by us.
7.3 The tickets are organized and partly co-financed by the fan club and therefore may not be resold with profit!
7.4 Seats or seat neighbours can be requested. These wishes will be fulfilled if possible. However, there is no entitlement to a specific seat or to specific seat neighbours.
8. security and data protection. The data necessary for the transaction will be stored. All personal data will of course be treated confidentially. We reserve the right to use this data to verify the accuracy.
9. final provisions. Place of jurisdiction is the location of the membershop fans4roger or the Swiss residence of the customer. Swiss law is exclusively applicable.
The parties will try to settle any disputes arising from the execution of this contract amicably.
With the order of goods by the customer, these general terms and conditions are considered accepted. Changes or amendments to the general terms and conditions of business shall be made exclusively by us. These are made in writing.
